Gaym (IOS & Android applications and the associated website, Gaym.me), is a product that is part of the Casual Dating Division of Digital Quarter Pty Ltd, and hereafter are collectively known as the ‘Digital Quarter Network’;

This privacy policy, together with the Digital Quarter Pty Ltd Terms and Conditions of Use, and any additional terms, conditions, notices and disclaimers displayed elsewhere on the Digital Quarter Network govern your use of and access to the Digital Quarter Network. By accessing or using the Digital Quarter Network you agree to be bound by the Terms and Conditions of Use, the Digital Quarter Ltd Privacy Policy, and any additional terms, conditions, notices and disclaimers displayed elsewhere on the Digital Quarter Network.

We may change all or part of this Privacy Policy at any time. If we do, the new Privacy Policy will be posted on the Digital Quarter Network. Your continued use of the Digital Quarter Network will constitute your acceptance of any changes. ‘The network’ – means the Digital Quarter Network

‘You or your’ – means you or your and refers to your use of the Digital Quarter Network as a;

  • Casual User of the Digital Quarter Network, who has gained access to the Digital Quarter Network without logging in using a username and password chosen by you. Casual users access the Digital Quarter Network without payment or cost (other than bandwidth and connectivity costs which may be payable to third-parties); or,
  • Registered User (also known as a guest) who has registered with an entity which forms part of the Digital Quarter Network and who has created a username and password for use on the site to which you have registered. Registered Users use the portion of the Digital Quarter Network, to which they have registered without payment or cost (other than bandwidth and connectivity costs which may be payable to third-parties); or,
  • Member who has registered with an entity which forms part of the Digital Quarter Network and who has created a username and password. Members have paid for a membership which entitles them to the level of service commensurate with the level of membership purchased. Members may additionally be liable to third-parties for costs associated with bandwidth and connectivity.

We are bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Commonwealth) (the Privacy Act).

What Is Personal Information?

When used in this policy, the term ‘ personal information’ has the meaning given to it in the Privacy Act. In general terms, it is any information that can be used to personally identify you. Information you post

The Digital Quarter Network is designed to enable you to communicate with others.

Any information or content you post when using the network becomes public information and is subject to redistribution by us and other third-parties. There is no expectation of privacy when posting content or participating in interactive forums.

We have no control over how those users may use the information you make public.

You should exercise caution and discretion when deciding to disclose your personal information in a submission or posting

Information given to us by third-party’s

Additionally, we may collect information about you which we have received from third-parties. For example if you access our websites or applications through a third-party connection or log-in, such as Facebook Connect, that third-party may pass some information about your use of its services to us. This information may include, but is not limited to;

  • Your user ID associated with your third-party account (for example, your Facebook user ID).
  • Any information you have permitted the third-party to share with us.
  • Any information you have made public in connection with the third-party provider.
  • If you have allowed us to access your ‘friends list’ held by the third-party provider, we will be given access to that list as well as your friends’ user IDs and your connection to those friends. We may store those details to make your experience more enjoyable and social and to allow you to invite your friends to use or join the Digital Quarter. We will also be able to let you know when one of your friends joins the network.

Mobile/location information

We may collect additional information from you if you access the network through a mobile device. For example, we may collect your unique device identifier, your device’s operating system, the name of your mobile carrier and network, details of your location, and with your permission your GPS/geo-location and billing information.

The degree to which your location can be identified depends on the device you are using (e.g. smart phone, tablet, laptop or desktop).

We collect this information in order to provide you with the best level of service.

If you are unable location services we may collect location data periodically as you use, or leave open your access to the network. We may also use this data internally or in conjunction with our third-party service providers to customise your experience and provide offers that may be relevant to you. Depending on the platform you use (e.g. Apple OSX iOS, Windows, Android etc), to access the network you may be able to control, from within your devices settings, whether you wish to share your location data with us.

What Happens If We Can’t Collect Your Personal Information?

If you do not provide us with the personal information described in this policy, some or all of the following may happen:

  • we may not be able to provide you with the products or services you requested, either to the same standard, or at all (for example, if you do not register as a member of a website, you will not be able to access features or services that are reserved for registered users or members only);
  • we may not be able to provide you with information about products and services that you may want, including information about discounts sales or special promotions; or
  • we may be unable to tailor the content of our network your preferences and your experience of our websites may not be as enjoyable or useful.

Accessing and Correcting Your Personal Information

How You Can Complain about a Breach of Privacy

We have a formal procedure for investigating and dealing with privacy breaches. Once the Privacy Officer receives a complaint in writing the Privacy Officer will commence an investigation. The investigator will endeavour to determine whether there has been a breach, the nature of the breach and how it occurred. We may contact you during the process to seek any further clarification if necessary. If a breach is found, the Privacy Officer will escalate the matter to management so that the process can be rectified to prevent any further breaches from taking place. We will also contact you to inform you of the outcome of the investigation. We will endeavour to resolve all investigations within a reasonable time.

Our representative will contact you within a reasonable time after receipt of your complaint to discuss your concerns and outline options regarding how they may be resolved. The Digital Quarter Network operates in a number of international jurisdictions including Australia, New Zealand, the USA and the UK.
